Terms of Service

These terms are an agreement between you and ARCHINEXT, Hyderabad, India ("we", "us"), for the website archinext.in and Site Intelligence at app.archinext.in (the "Services"). By creating an account or using the Services, you accept these terms and our Privacy Policy. If you use the Services for an organisation, you confirm you may accept these terms on its behalf.

1. Accounts

• You must be 18 or older, or have a parent's or guardian's consent, and you must give accurate details.
• Keep your password safe. You are responsible for activity on your account. Tell us at once if you suspect misuse.
• A workspace owner controls its members, roles and projects, and may remove members.

2. Plans and limits

The Services are offered as Free, Education, Pro and Pro Max plans. Each plan sets which analyses and booklets you can use, how many new projects you can start, and the largest study area. The current details are shown in the app. The Education plan needs a verified college email address and lasts one year from verification, after which you verify again. Verifying a college address shows that you control it, not that you are enrolled.

Where a plan is paid, prices, billing periods and taxes are shown before you buy. Fees are non-refundable except where the law or a written promise from us says otherwise. If your plan ends or you move to a lower plan, your projects are kept, but results above your new plan's level are withheld until you upgrade. We may change plans and features in future. If a change takes away something you have paid for, we will tell you in advance and it will take effect at your next renewal.

3. Acceptable use

You agree not to:

• break the law, or infringe anyone's rights, including privacy and intellectual property;
• get around plan limits, security or access controls, or use another person's account or a college address that is not yours;
• scrape, overload or resell the Services or their data feeds, or use automated access beyond normal use of the app;
• probe or test for vulnerabilities without our written permission (write to us; we welcome responsible reports);
• upload malicious code, or content that is unlawful, harmful or not yours to share.

We may suspend or close accounts that break these rules, after a warning where reasonable.

4. Your content and outputs

You keep ownership of what you put in, such as projects, study settings and booklet text, and of the drawings, models and booklets you export, subject to the data licences below. You give us permission to store and process your content only to provide the Services to you and your workspace.

5. Data sources and licences

Analyses are built from public and open data, including OpenStreetMap (© OpenStreetMap contributors, ODbL), Open-Meteo, NASA, Copernicus, Overture Maps, Google Open Buildings, ISRIC, WorldPop and Indian government sources. Their licences continue to apply to outputs that contain their data, including any attribution they require. The app shows the source of each reading.

6. Reports are guidance

Site Intelligence produces reports, drawings, models and booklets from public and open data and from simulations. They are guidance to support your work, not a final assessment. Open data can be incomplete, out of date or inaccurate, and simulations are approximations. Outputs are not a survey, a geotechnical or structural investigation, a legal or planning opinion, or approval from any authority.

You are responsible for carrying out your own thorough assessment before you rely on any output, including site surveys, investigations, professional advice and checks with the relevant authorities. Decisions made using the outputs are yours.

7. Our property

The Services, their software, design, models and the ARCHINEXT name and marks belong to us or our licensors. These terms give you a limited, personal, non-transferable right to use the Services. They do not transfer ownership or allow copying or reverse engineering, except as the law permits.

8. Availability and changes

We work to keep the Services available and your data backed up, but we provide them "as is" and "as available", without guarantees of uninterrupted or error-free service. We may improve, change or retire features. We will give reasonable notice before retiring something material on a paid plan.

9. Ending

You may stop using the Services and ask us to delete your account at any time. We may suspend or end access for a serious or repeated breach of these terms, or if the law requires. The sections on content, licences, guidance and law continue to apply after these terms end.

10. Law and disputes

These terms are governed by the laws of India. Courts in Hyderabad, Telangana, have exclusive jurisdiction, subject to any rights you have as a consumer under Indian law. Please contact us first, since most issues can be resolved quickly.

11. Changes and contact

We may update these terms and will post the new version here with its date. We will give notice of material changes by email or in the app. If you continue to use the Services after a change takes effect, you accept it.
